Privacy policy
The protection of information and respect for your privacy while using our Service is of the utmost value to us. Therefore, we ensure the appropriate security and comfort of using our websites. In this policy, we explain the principles and scope of our processing of your data, as well as the rights and obligations you have in this regard.
1. Data Controller and Definitions
The data controller is Herse 1868 Sp. z o.o. with its registered office in Krakow, at ul. Sukiennicza 8/U3, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Krakow-Śródmieście in Krakow, XI Economic Division of the National Court Register under KRS number: 0000835209, holding REGON: 385832765, NIP: 6762579349, which operates through the online store www.herse.com. User – a natural person entering the website(s) of the Online Store or using the services or functionalities described in this Privacy Policy.
Customer – a natural person with full legal capacity, a natural person who is a Consumer, a legal person, or an organizational unit without legal personality to which the law grants legal capacity, who concludes a distance sales agreement with the Seller.
Online Store – a web service run by the Seller, available at the electronic addresses (websites): www.herse.com, through which the Customer/User can obtain information about a product and its availability, and purchase products or order a service.
Newsletter – information, including commercial information within the meaning of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2020, item 344), from the Seller sent to the Customer/User by electronic means; its receipt is voluntary and requires the consent of the Customer/User.
Account – a collection of data stored in the Online Store and in the Seller's IT system concerning a given Customer/User and their placed orders and concluded agreements, which the Customer/User can use to place orders and conclude agreements.
GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
If the Customer does not consent to the processing or use of their data by the Controller in accordance with these data protection provisions in whole or in relation to specific activities, they may object by e-mail or traditional mail, also using the contact details provided.
2. Collection, processing, and use of personal data
The collection, processing, and use of personal data by the Controller concerns the factual or personal connections of a specific or identifiable natural person for the purpose of executing an order or service. This includes, for example, name and surname, telephone number, address, and all basic data that the Customer has provided to Herse 1868 Sp. z o.o. when ordering the execution of an order or service.
3. Purpose of personal data processing
Your personal data is processed by the Controller for many purposes, to a different extent, and on various legal bases provided for by the GDPR. The following are examples:
- performance of a contract
- realization of the legitimate interests of the Controller
- protection of the vital interests of the data subject or another natural person
- processing of personal data for one or more purposes for which the consent of the data subject is required
4. Customer data processing
The Controller processes user data as part of handling purchases, including any subsequent warranty claims, for the purpose of providing its services, for technical administration, for its own marketing purposes, and to prevent illegal acts and fraud. Users' personal data is transferred to third parties only when this is permitted by law, including for purposes related to the execution of the contract or settlement, for marketing purposes, or in the case of the user's prior consent. For example, as part of order processing, the service providers cooperating with us (e.g., a carrier, a logistics company, banks) receive the necessary data to execute the order and commission. The data transferred in this way may be used by the service providers solely for the purpose of carrying out their tasks.
5. Marketing
Direct marketing of our own services and monitoring the quality of the online store's services is possible after obtaining the Customer's consent. Consent to the processing of data for the purpose described in the preceding sentence is voluntary and may be withdrawn at any time.
6. Data security
The Controller undertakes to store data securely.
The Controller undertakes to apply technical and organizational measures to ensure data protection, in particular by securing data against its disclosure to unauthorized persons.
7. Right to data erasure
The Customer has the right to request the modification or erasure of the data processed by the Controller. The Customer's request will be fulfilled, unless further processing is required of the Controller by law, a legal obligation which the Controller must fulfill arises from the law, or when the Customer's data is not necessary for the establishment, exercise, or defense of legal claims.
8. Cookie files
The Online Store uses "cookies". Failure to change the browser settings on the part of the Service Recipient is tantamount to consenting to their use.
The installation of "cookies" is necessary for the proper provision of services in the Store. "Cookies" contain information necessary for the proper functioning of the Store, in particular those requiring authorization.
The Store uses three types of "cookies": "session", "persistent", and "analytical".
"Session" cookies are temporary files that are stored on the Service Recipient's end device until logging out (leaving the Store).
"Persistent" cookies are stored on the Service Recipient's end device for the time specified in the parameters of the cookies or until they are deleted by the Service Recipient.
"Analytical" cookies allow for a better understanding of how the Service Recipient interacts with the content of the Store and help to better organize its layout. "Analytical" cookies collect information about the way the Service Recipient uses the Store, the type of page from which the Service Recipient was redirected, and the number of visits and the time of the Service Recipient's visit to the Store's website. This information does not record the specific personal data of the Service Recipient but is used to compile statistics on the use of the Store.
The Service Recipient has the right to decide on the access of "cookies" to their computer by pre-selecting them in their browser window. Detailed information on the possibilities and methods of handling "cookies" is available in the software settings (web browser).
